The Pollution Liability Insurance Agency (PLIA) invites the public to comment. This is a proposal to remove Ben’s Deli Mart (“Site”) from the Department of Ecology’s Hazardous Sites List pursuant to WAC 173-340-330(10).

The Site was developed with the current structure and gasoline station in 1985. In 1994, a petroleum spill was observed during the removal of three (3) USTs at the Site. Approximately 71 tons of petroleum-impacted soil were transferred off-Site at that time along with an undetermined amount of petroleum contaminated groundwater. Remediation at the Site has occurred intermittently since 1994.

In 2019, a diesel release was discovered below a fuel dispenser. Approximately 8-10 tons of diesel-contaminated soil and 5-10 gallons of potential petroleum contaminated groundwater were removed from the Site at this time. Subsequent soil samples did not detect any contaminants of concern (COCs) above state cleanup levels. Additionally, from April 2021 to December 2022, five quarters of groundwater sampling were conducted which did not detect any COCs above state cleanup levels. Soil vapor sampling conducted between the former excavation and on-Property structure also did not detect COCs above state cleanup levels during a March 2021 analysis.

PLIA performed regulatory oversight of the Site under the agency’s Technical Assistance Program (TAP). Based on the Site review, PLIA determined that the Site meets the substantive requirements of the state clean up regulations, Chapter 173-340 WAC Model Toxics Control Act, and no longer poses a threat to human health or the environment.
