The Pollution Liability Insurance Agency (PLIA) invites the public to comment. This is a proposal to remove Elliott Bay Marina (“Site”) from the Department of Ecology’s Hazardous Sites List pursuant to WAC 173-340-330(10).

The Site lies within a paved plaza bounded by commercial buildings to the north, landscaping to the west and east, and Elliott Bay and marina moorage to the south. A commercial marina was constructed at the property on engineered fill in 1990-1991 under previous ownership and management.

In 2005 a gasoline leak from a 30,000-gallon underground storage tank (UST) and associated piping was discovered. At this time, a remedial action conducted at the Site removed gasoline-impacted soil totaling approximately 14 tons for off-site disposal, and the UST and associated piping were repaired. In-situ treatment with a hydrogen peroxide solution was also applied at the Site. Soil samples obtained in 2022 demonstrated that the hydrogen peroxide solution treatment decreased petroleum contaminated soil to levels below the state cleanup requirement.

Between 2019-2023, five quarters of groundwater monitoring were performed at the Site. Site contaminants of concern (COCs) were not detected at levels above state cleanup requirements. Additionally, two rounds of soil vapor sampling performed in July and December 2022 indicated that Site COC vapor concentrations were also below the cleanup levels required by the state.

PLIA performed regulatory oversight of the Site under the agency’s Technical Assistance Program (TAP). Based on the Site review, PLIA determined that the Site meets the substantive requirements of the state clean up regulations, Chapter 173-340 WAC Model Toxics Control Act, and no longer poses a threat to human health or the environment.
