The Pollution Liability Insurance Agency (PLIA) invites the public to comment. This is a proposal to remove Lenny’s Fuel East (“Site”) from the Department of Ecology’s Hazardous Sites List pursuant to WAC 173-340-330(10).

The Site is developed with a single commercial building which is currently vacant. A heating oil fuel supply business previously operated on the Site from the 1940s to around 1997. Three underground storage tanks (USTs) used by the fuel supply company were removed in 1991. At the time of removal, a remedial excavation was completed and soil samples were collected. The samples showed that diesel range hydrocarbons were at concentrations below state cleanup requirements. Another heating oil commercial UST was closed in place.

In 2015 and 2023, soil sampling was performed in the vicinity of the closed-in-place heating oil UST. None of the samples showed petroleum contamination above state cleanup requirements. Additionally, contamination was not found to be present in groundwater samples collected in 2023. It was also determined that petroleum contaminated soil was successfully remediated to a level below state cleanup requirements.

PLIA performed regulatory oversight of the Site under the agency’s Technical Assistance Program (TAP). Based on the Site review, PLIA determined that the Site meets the substantive requirements of the state clean up regulations, Chapter 173-340 WAC Model Toxics Control Act, and no longer poses a threat to human health or the environment.
