The Pollution Liability Insurance Agency (PLIA) invites the public to comment. This is a proposal to remove the Sunset Food Mart (“Site”) from the Department of Ecology’s Hazardous Sites List pursuant to WAC 173-340-330(10).

The Site is an active gas station and convenience store located in Spokane, Washington. It includes a 1,144 square-foot building, three fuel dispensers covered by a 1,200-square-foot canopy, and a 20,000-gallon underground storage tank (UST) divided into three compartments.

In January 2009, three 4,000-gallon USTs and associated fuel piping and dispensers were replaced with the 20,000-gallon UST. During this process, petroleum contaminated soil was discovered. Shortly after, approximately 981.53 tons of soil was removed from the Site.

Following a remedial investigation of the Site in October 2021, sampling results showed that petroleum contamination in the soil no longer existed at a level above state cleanup requirements. Additionally, groundwater was not encountered at the Site, and soil vapor sampling results conducted in January 2022 show that future management of soil vapor is not required at the Site.

PLIA performed regulatory oversight of the Site under the agency’s Technical Assistance Program (TAP). Based on the Site review, PLIA determined that the Site meets the substantive requirements of the state clean up regulations, Chapter 173-340 WAC Model Toxics Control Act, and no longer poses a threat to human health or the environment.
