The Pollution Liability Insurance Agency (PLIA) invites the public to comment. This is a proposal to remove UPS Burlington (“Site”) from the Department of Ecology’s Hazardous Sites List pursuant to WAC 173-340-330(10).

UPS Burlington (“Site”) is currently occupied by an active UPS package distribution center and includes a warehouse building, which was constructed in 1972. One 7,500-gallon unleaded gasoline underground storage tank (UST) previously located on the Site was removed in 1995. At the time of its removal, a petroleum release in the vicinity of the UST was discovered. In 1995 and 1996, approximately 210 cubic yards of petroleum-impacted soil was excavated and disposed of off-Site. In addition, approximately 300 gallons of potential petroleum contaminated groundwater was pumped from the excavation into a temporary containment tank and disposed of at a treatment facility off-Site.

Another excavation performed in 2019 removed 121 tons of petroleum-impacted soil from the Site. Subsequent soil samples showed that petroleum contamination in the soil no longer existed at the site above state cleanup requirements, and four quarters of groundwater monitoring results from 2020 also showed that groundwater contamination on the Site had declined to levels below state cleanup levels.

PLIA performed regulatory oversight of the Site under the agency’s Technical Assistance Program (TAP). Based on the Site review, PLIA determined that the Site meets the substantive requirements of the state clean up regulations, Chapter 173-340 WAC Model Toxics Control Act, and no longer poses a threat to human health or the environment.
